*Per the 2019 Infomercials agreement, all infomercials will be at the 19.00% Commercial rate and contributions will be made to the SAG-AFTRA Health Plan and the AFTRA Retirement Fund.
Effective January 1, 2012, no Producer shall be obligated to make contributions on behalf of any individual performer on gross compensation in excess of $1,000,000 for covered services in a contract year where all such compensation has been paid on the basis of a single contract with a single Producer.
Separate ceilings apply to Multiple Services Contracts that are covered under the SAG-AFTRA Commercials Contract and the SAG-AFTRA Audio Commercials Contract.
A Multiple Services Contract (MSC) is a performer’s agreement with a sponsor that specifies multiple services to be rendered for advertising. Examples of services include, but are not limited to, television commercials, radio commercials, personal appearances, print work, etc. Under this type of contract, the payor/signatory is required to specify the contribution amounts due to the SAG-Producers Pension Plan and AFTRA Retirement Fund. Failure to properly disclose and submit the correct amounts can result in liquidated damages and/or interest.
It is ultimately the responsibility of the signatory to make sure the contribution amounts are correct. For allocation guidelines, please refer to:
According to the SAG-AFTRA Commercials Contract and SAG-AFTRA Radio Commercials Contract, “Producer shall designate multi-service contract status on the contribution remittance form/reports filed with the Plans/Funds when contributions are tendered in connection with services related to multiple-service agreement. Producer agrees to provide un-redacted copies of all contracts relating to services provided under such multiple-service agreements to the Union/SAG-AFTRA and to the Plans/Funds at the time of submission of initial contribution reports to the Plans/Funds.
The MSC Contract Cover Sheet is required to be submitted when reporting Multiple Service Commercial Allocation earnings.
